1. Introduction
Nimble Energy ("Nimble Energy," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy describes how we collect, use, share, and protect personal information when you visit our website at nimble-energy.com (the "Site"), use our energy management tools, including our Savings Calculator (collectively, the "Services"), or otherwise interact with us.
If you are a resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, or Washington, please see Section 9 (State-Specific Disclosures) for additional rights and disclosures that apply to you.
2. Acceptance of Privacy Policy
By using the Site or the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Site or the Services.
3. Information We Collect
We collect personal information in the following ways:
A. Information You Provide Directly. When you fill out a contact or quote request form, request a demo, use the Savings Calculator, create an account (if applicable), subscribe to our newsletter, send us a message through our chat widget, or otherwise contact us, you may provide:
• Identifiers and contact information: name, business name, job title, email address, phone number, and mailing address.
• Commercial information: facility or property details, energy usage information you enter into our tools (e.g., utility data, square footage, equipment information), and services purchased or inquired about.
• Account credentials (if applicable): username and password.
• Communications content: the contents of messages, support tickets, chat conversations, and SMS replies.
B. Information Collected Automatically. When you visit the Site, we (and our service providers) automatically collect certain information through cookies, pixels, and similar technologies, including:
• Device and usage information: IP address, browser type, operating system, referring URLs, pages viewed, time spent on pages, clickstream activity, and approximate (city-level) location derived from your IP address.
• Cookie identifiers and similar tracking data. See Section 6 (Cookies and Tracking Technologies).
C. Information from Third Parties. We may receive information from:
• Marketing and analytics service providers (e.g., Google Analytics, list providers).
• Public sources and business directories.
• Referrals from existing customers or partners.
D. Sensitive Personal Information. We do not knowingly collect "sensitive personal information" as defined under applicable U.S. state privacy laws (such as Social Security numbers, government-issued identifiers, financial account numbers, precise geolocation, account passwords without other identifiers, racial or ethnic origin, religious or philosophical beliefs, genetic or biometric identifiers, or health information). If you voluntarily provide such information in a message to us, we will treat it confidentially and use it only as needed to respond to you.
4. How We Use Your Information
We use the information we collect for the following business and commercial purposes:
• To provide, maintain, and improve the Site and Services, including the Savings Calculator.
• To respond to inquiries, requests for quotes, and customer support requests.
• To send transactional communications (e.g., appointment confirmations, account notifications, service-related notices).
• To send marketing communications about Nimble Energy products, services, promotions, events, and updates, where permitted by law and subject to your communication preferences.
• To personalize content and improve the user experience on the Site.
• To analyze use of the Site and Services and to measure the effectiveness of our marketing.
• To prevent fraud, secure the Site, and enforce our Terms of Service.
• To comply with legal obligations, respond to subpoenas or governmental requests, and protect our rights, property, and safety, and the rights, property, and safety of others.
• To facilitate a business transaction such as a merger, acquisition, financing, or sale of assets.
5. How We Share Your Information
We share personal information only in the following circumstances:
A. Service Providers. We share personal information with vendors and contractors who process information on our behalf under written contracts that restrict their use of the information to providing services to us. Categories of service providers include:
• Website hosting and infrastructure providers.
• Analytics providers, including Google LLC, which provides Google Analytics 4 (property G-JKHJ900772). Google Analytics is configured in analytics-only mode; Google Signals and ad personalization features are disabled, and we have accepted Google's Data Processing Terms.
• CRM, lead-management, and communications platforms, including GoHighLevel / LeadConnector, which powers our website chat widget and lead forms.
• Email and SMS delivery providers.
• Payment processors (if applicable to the Service you use).
• Professional advisors (legal, accounting, insurance).
B. Legal and Safety. We may disclose personal information if required by law, subpoena, court order, or governmental request, or where we believe in good faith that disclosure is necessary to protect our rights, the safety of you or others, investigate fraud or security incidents, or respond to a government request.
C. Business Transfers. In connection with a merger, acquisition, financing, reorganization, or sale of all or a portion of our business, we may transfer personal information as part of the transaction.
D. With Your Consent. We may share information in other ways with your consent or at your direction.
E. No Sale; No Sharing for Cross-Context Behavioral Advertising. We do not sell your personal information for monetary or other valuable consideration, and we do not share your personal information for "cross-context behavioral advertising" (i.e., targeted advertising across non-affiliated websites or applications based on personal information obtained from your activity on our Site). We have not sold or shared personal information of consumers (including consumers under 16) in the preceding 12 months. If this changes in the future, we will update this Privacy Policy and provide the disclosures and opt-out mechanisms required by applicable law.
6. Cookies and Tracking Technologies
We use cookies, pixels, local storage, and similar technologies on the Site for the following purposes:
• Strictly necessary cookies required for the Site to function (e.g., security, load balancing, recording your cookie preferences).
• Functional cookies that remember preferences and improve usability.
• Statistics / analytics cookies that help us understand how visitors interact with the Site, including via Google Analytics 4. Google Analytics is configured in analytics-only mode; Google Signals and ad personalization features are disabled.
• Marketing cookies associated with the GoHighLevel chat widget and embedded video (e.g., YouTube). We do not run third-party advertising pixels (e.g., Meta Pixel, Google Ads tag, LinkedIn Insight Tag) at this time.
Consent management. We use a cookie consent banner that allows you to accept or reject non-essential cookies before they are set on your device. You can change or withdraw your consent at any time by clicking the "Your Privacy Choices" link in the footer of the Site.
Global Privacy Control (GPC). We honor browser-based opt-out preference signals, including the Global Privacy Control signal, as a valid request to opt out of the sale or sharing of your personal information. When a GPC signal is detected, we apply the opt-out automatically to your browser or device.
Third-party opt-outs. In addition to our consent banner, you may opt out of certain third-party tracking directly:

7. Communications
We may use your email address to send transactional messages, newsletters, promotional offers, and other marketing content. You can opt out of marketing emails at any time by using the unsubscribe link in any marketing email, or by emailing us at info@nimble-energy.com. Even if you opt out of marketing emails, we may still send you transactional and service-related communications.
SMS / Text Messaging
We collect your mobile number only when you provide it through our forms or services, such as quote requests, and check the explicit opt-in box on the form. By checking the opt-in box and submitting your information, you provide verifiable, written consent to receive SMS messages from Nimble Energy, including responses to inquiries, appointment confirmations, reminders, and promotional offers. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for more information. We comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and applicable carrier requirements for all SMS communications. Your consent is documented and may be revoked at any time. Mobile information and SMS opt-in data are not shared with third parties for marketing purposes.
8. Your Privacy Rights
Subject to applicable law and verification of your identity, you may have the following rights with respect to your personal information:
• Right to Know / Access. You may request that we disclose what personal information we collect, use, disclose, and (if applicable) sell or share about you.
• Right to Delete. You may request that we delete personal information we have collected from you, subject to certain exceptions (e.g., to complete a transaction, comply with law, detect or resolve security incidents, exercise free-speech rights, or comply with other lawful purposes).
• Right to Correct. You may request that we correct inaccurate personal information we maintain about you.
• Right to Data Portability. You may request a copy of your personal information in a portable, readily usable format.
• Right to Opt Out of Sale, Sharing, or Targeted Advertising. You may opt out of any "sale" of your personal information or any "sharing" of your personal information for cross-context behavioral or targeted advertising. As noted in Section 5, we do not currently engage in either.
• Right to Limit Use of Sensitive Personal Information. You may direct us to limit our use and disclosure of sensitive personal information to that necessary to provide the Services. As noted in Section 3, we do not knowingly collect sensitive personal information.
• Right to Opt Out of Profiling. Where applicable, you may opt out of "profiling" that produces legal or similarly significant effects. We do not currently engage in such profiling.
• Right to Non-Discrimination. We will not discriminate against you for exercising these rights.
• Right to Appeal. If we deny your privacy rights request, you may appeal our decision by emailing us at info@nimble-energy.com with the subject line "Privacy Rights Appeal." We will respond to appeals within 60 days (or any shorter period required by your state's law).

Verification. Before fulfilling a request to know, delete, correct, or port personal information, we will verify your identity by matching information you provide with information we already have (typically two data points, such as your name and an email address or phone number associated with your prior interaction with us). For sensitive requests or requests for specific pieces of information, we may require additional verification.
Authorized agents. You may use an authorized agent to submit a request on your behalf. The agent must provide written authorization signed by you and proof of their own identity. We may also require you to verify your own identity directly and confirm to us that you have authorized the agent.
Response timeframes. We will confirm receipt of your request within 10 business days and substantively respond within 45 days, with one 45-day extension where reasonably necessary and permitted by law (90 days total). For states with shorter response windows, we will respond within the timeframe required by the applicable state law.
9. State-Specific Disclosures
The rights described in Section 8 apply broadly. The following sections describe state-specific rights and disclosures.
California (CCPA / CPRA)
In addition to the rights described in Section 8, California residents have the following rights and disclosures.
Categories of personal information we have collected in the prior 12 months (using the categories defined in the California Consumer Privacy Act):
• Identifiers (e.g., name, email, phone, IP address, online identifiers).
• Customer records information (e.g., name, contact information, employer or business name).
• Commercial information (e.g., services inquired about or purchased, energy usage information you provide).
• Internet or other electronic network activity information (e.g., browsing activity, interaction with the Site, referring URLs).
• Geolocation data (approximate, IP-derived; not precise).
• Professional or employment information (e.g., job title, employer, where provided).
• Inferences drawn from the above to create a profile reflecting preferences, characteristics, or behavior relevant to our Services.
Sources of personal information: directly from you; automatically from your device when you use the Site; from our service providers; from publicly available sources and business directories.
Business or commercial purposes for collection: as described in Section 4.
Categories of third parties with whom we share personal information: as described in Section 5 (service providers; legal or governmental authorities when required; counterparties in business transfers; and others with your consent).
Sale or Sharing. We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We have not sold or shared personal information of consumers (including consumers under 16) in the preceding 12 months.
Sensitive Personal Information. We do not knowingly collect sensitive personal information for purposes beyond those permitted by California law without additional disclosure (such as providing the Services you request).
Retention. See Section 11.
"Your Privacy Choices." California residents may submit opt-out and other privacy rights requests at any time using the "Your Privacy Choices" link in the footer of the Site, by emailing info@nimble-energy.com, by calling (919) 389-1796, or by mail. We also honor the Global Privacy Control as a valid opt-out preference signal.
Shine the Light (Cal. Civ. Code § 1798.83). California residents may request information about disclosures of personal information to third parties for the third parties' direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.
Minors. We do not knowingly sell or share the personal information of consumers we know to be younger than 16.
Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, and Texas
Residents of these states have the rights described in Section 8, including the rights to access, correct, delete, port, opt out of targeted advertising, opt out of the sale of personal data, opt out of profiling in furtherance of decisions that produce legal or similarly significant effects, and appeal. We honor universal opt-out preference signals, including the Global Privacy Control, where required by the applicable state law.
Virginia, Utah, Iowa, Indiana, Kentucky, Tennessee, and Rhode Island
Residents of these states have the rights described in Section 8, except as limited by the respective state law (for example, Utah and Iowa do not currently provide a right to correct).
Washington (My Health My Data Act)
Washington's My Health My Data Act applies to "consumer health data." We do not knowingly collect consumer health data. If you believe you have provided such information and would like to exercise your rights under that law, please contact us at info@nimble-energy.com.
Nevada (NRS 603A)
Nevada residents may submit a verified request directing us not to sell certain "covered information." We do not sell covered information as defined under Nevada law.
10. Global Privacy Control
We honor browser-based opt-out preference signals, including the Global Privacy Control (GPC), as a valid request to opt out of the sale or sharing of personal information. When the GPC signal is detected, we apply the opt-out automatically to your browser or device for the duration of the signal.
11. Data Retention
We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including:
• Lead and inquiry information: up to 3 years from your last interaction, unless you become a customer or have opted into ongoing marketing communications.
• Customer and account information: for the duration of the customer or account relationship and up to 7 years thereafter, for tax, accounting, and legal compliance.
• Analytics data: typically up to 14 months in Google Analytics 4, and indefinitely in aggregated, de-identified form.
• SMS opt-in records: as required by TCPA and carrier guidelines.
We will delete or de-identify personal information when it is no longer needed, unless we are required to retain it by law.
12. Data Security
We implement reasonable administrative, technical, and physical security measures designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and applicable authorities as required by law.
13. Children's Privacy
The Site and Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly. Parents or guardians who believe their child has provided us with personal information may contact us at info@nimble-energy.com. Consistent with California law, we do not knowingly sell or share the personal information of consumers we know to be younger than 16 without affirmative authorization.
14. Third-Party Websites and Services
The Site may contain links to, or embedded content from, third-party websites and services (for example, LinkedIn and YouTube). This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you use.
15. International Users
The Site and Services are intended for users in the United States. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, which may have different data protection laws than your country of residence.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent version. For material changes, we will provide additional notice (such as a banner on the Site or an email to subscribers). Your continued use of the Site or Services after the effective date constitutes acceptance of the updated Privacy Policy.
17. Governing Law
This Privacy Policy and any disputes relating to it are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, except where applicable state privacy laws require otherwise. Disputes are subject to the dispute-resolution provisions of our Terms of Service.
